Kullanım Koşulları

Bu koşullar, Voyarch uygulamasını kullanımını düzenleyen sözleşmedir. Uygulamayı kullanarak bu koşulları kabul etmiş olursun. Lütfen dikkatlice oku.

1. Koşulların kabulü

Voyarch ("uygulama", "hizmet", "biz") ile sen ("kullanıcı") arasındaki bu sözleşme, hesap oluşturduğunda veya uygulamayı kullandığında yürürlüğe girer. Koşulları kabul etmiyorsan uygulamayı kullanmamalısın. Hizmet şu anda öncelikle Türkiye'deki kullanıcılara yöneliktir.

2. Uygunluk ve yaş

Voyarch'ı kullanmak için en az 18 yaşında olmalısın. 18 yaşından küçüksen hesap oluşturamaz, uygulamayı veya doğrudan mesajlaşmayı kullanamazsın. Kayıt olurken doğru doğum tarihi vermeli ve yetişkin olduğunu beyan etmelisin. Yanlış yaş bilgisi erişimin kısıtlanmasına veya hesabın kapatılmasına yol açabilir.

3. Hesabın

• Kayıt olurken doğru ve güncel bilgi vermelisin.
• Hesabının ve şifrenin güvenliğinden sen sorumlusun; hesabın altında gerçekleşen etkinliklerden sorumlu tutulabilirsin.
• Hesabını başkasına devredemez, başkası adına sahte hesap açamazsın.
• Hesabında yetkisiz bir kullanım fark edersen bize bildirmelisin.

4. İçeriğin ve verdiğin lisans

Paylaştığın fotoğraf, video, yazı ve diğer içeriğin ("kullanıcı içeriği") sahibi sensin. İçeriğini bize devretmezsin. Ancak hizmeti sunabilmemiz için — içeriğini uygulamada göstermek, saklamak, çoğaltmak ve diğer kullanıcılara (senin görünürlük ayarların çerçevesinde) iletmek amacıyla — bize dünya çapında, telifsiz, devredilebilir ve alt lisanslanabilir sınırlı bir kullanım lisansı vermiş olursun. Bu lisans yalnızca hizmeti işletmek içindir ve içeriğini sildiğinde (yedekleme/teknik gereklilikler ile Gizlilik Politikası §6'da açıklanan, hukuken saklanması gereken sınırlı kayıtlar dışında) sona erer.

Paylaştığın içerik için gerekli tüm haklara sahip olduğunu ve içeriğinin üçüncü kişilerin haklarını (telif, gizlilik vb.) ihlal etmediğini taahhüt edersin.

Başka bir kullanıcıya gönderdiğin doğrudan mesaj da kullanıcı içeriğidir ve alıcıya iletilmesi, güvenli saklanması ve şikayet hâlinde sınırlı olarak incelenmesi için aynı hizmet lisansına tabidir.

5. Kabul edilebilir kullanım

Voyarch bir topluluktur ve sakıncalı içeriğe sıfır tolerans gösteririz. Aşağıdakileri yapamazsın:

• yasa dışı, tehdit edici, taciz edici, nefret söylemi içeren, ayrımcı, müstehcen veya şiddet içeren içerik paylaşmak;
• başkalarını taciz etmek, zorbalık yapmak, tehdit etmek veya kişisel bilgilerini rızası olmadan ifşa etmek;
• spam, dolandırıcılık, yanıltıcı veya istenmeyen içerik yaymak;
• başkasının kimliğine bürünmek veya sahte hesap oluşturmak;
• başkalarının fikri mülkiyet haklarını ihlal etmek;
• uygulamanın çalışmasını bozacak, güvenliğini test edecek veya otomatik/bot erişim sağlayacak eylemlerde bulunmak;
• reşit olmayanları istismar eden ya da tehlikeye atan her türlü içerik (kesinlikle yasaktır).

Ayrıntılı davranış ve içerik kuralları için Topluluk Kuralları'na bak. Bu kurallar gönderiler, yorumlar ve doğrudan mesajlar için geçerlidir.

6. Konum doğruluğu ve dürüstlük

Voyarch'ın temeli, gerçekten gittiğin yerleri paylaşmandır. Konumunu taklit etmek, sahte GPS kullanmak veya bulunmadığın bir mekândan gönderi oluşturmaya çalışmak yasaktır. Bu tür hile tespit edildiğinde ilgili gönderiler, puanlar veya hesap askıya alınabilir ya da kaldırılabilir.

7. Puanlar, rozetler ve oyunlaştırma

Uygulama; puan, seviye, sezon puanı ve rozet gibi oyunlaştırma öğeleri içerir. Bunların gerçek para değeri yoktur, nakde çevrilemez ve hiçbir mülkiyet ya da parasal hak doğurmaz. Puanlama kurallarını, sezonları ve rozetleri zaman zaman değiştirebilir; hile veya kötüye kullanım hâlinde puanları düzeltebilir veya iptal edebiliriz.

8. Moderasyon, şikayet ve yaptırımlar

Uygulama içinden içerik veya kullanıcıları şikayet edebilir, hesapları engelleyebilirsin. Bu koşulları ihlal eden içeriği kaldırma, uyarı verme, özellikleri kısıtlama, hesabı askıya alma veya kapatma hakkımızı saklı tutarız. Ciddi ihlallerde bildirim yapmaksızın hemen işlem yapabiliriz.

Doğrudan mesaj ekranında belirli bir mesajı şikayet edebilir ve kullanıcıyı ayrı bir işlemle engelleyebilirsin. Şikayet incelemesi seçilen mesaj ve en fazla beş önceki mesajla sınırlıdır; moderatörler kullanıcı gelen kutularında serbestçe gezemez.

Kullanıcı içeriği otomatik metin ve görsel güvenliği kontrollerinden geçebilir. Riskli sonuçlar, görev için gerekli içerikle sınırlı olmak üzere yetkili moderatör tarafından incelenebilir. Ayrıntılar Gizlilik Politikası, Topluluk Kuralları ve Çocuk Güvenliği Standartları'nda açıklanır.

9. Fikri mülkiyet

Voyarch markası, logosu, tasarımı, yazılımı ve kullanıcı içeriği dışındaki tüm içerik bize aittir ve ilgili yasalarla korunur. Sana yalnızca uygulamayı kişisel ve ticari olmayan amaçla kullanman için sınırlı, devredilemez bir lisans verilir.

Bize ilettiğin öneri ve geri bildirimleri, sana karşı bir yükümlülük veya ücret borcu doğurmaksızın hizmeti geliştirmek için kullanabiliriz.

10. Üçüncü taraf hizmetler

Uygulama, harita, kimlik doğrulama, bildirim ve depolama gibi üçüncü taraf hizmetlere dayanır. Bu hizmetlerin kendi koşulları geçerli olabilir. Uygulamadan ulaştığın harici bağlantı veya içeriklerden biz sorumlu değiliz.

11. Garanti reddi

Hizmet "olduğu gibi" ve "mevcut olduğu ölçüde" sunulur. Mekân bilgileri, öneriler ve diğer içeriklerin doğruluğunu, kesintisizliğini veya belirli bir amaca uygunluğunu garanti etmeyiz. Uygulamayı kullanırken çevrene ve güvenliğine dikkat etmek senin sorumluluğundadır.

12. Sorumluluğun sınırlandırılması

Yürürlükteki hukukun izin verdiği azami ölçüde Voyarch; dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan, veri kaybından ya da kullanıcı içeriği veya diğer kullanıcıların davranışlarından doğan zararlardan sorumlu değildir.

13. Tazminat

Uygulamayı kullanımından, içeriğinden veya bu koşulları ihlalinden doğan üçüncü kişi taleplerine karşı Voyarch'ı tazmin etmeyi ve zarar görmesini önlemeyi kabul edersin.

14. Fesih

Hesabını istediğin zaman uygulama içinden dondurabilir veya silebilirsin (bkz.Gizlilik Politikası §6). Bu koşulları ihlal etmen hâlinde biz de hesabına erişimini sonlandırabiliriz. Fesihten sonra da niteliği gereği geçerli kalması gereken hükümler (fikri mülkiyet, sorumluluk sınırı, tazminat vb.) yürürlükte kalır.

15. Hizmette ve koşullarda değişiklikler

Hizmeti ve özelliklerini sürekli geliştiriyoruz; bir özelliği değiştirebilir, askıya alabilir veya kaldırabiliriz. Seni önemli ölçüde olumsuz etkileyecek değişikliklerde makul bir bildirim yapmaya çalışırız.

Bu koşulları da güncelleyebiliriz. Önemli değişikliklerde seni uygulama içinden veya e-posta ile bilgilendiririz. Değişiklikten sonra uygulamayı kullanmaya devam etmen, güncel koşulları kabul ettiğin anlamına gelir.

16. Uygulanacak hukuk ve uyuşmazlıklar

Bu koşullar Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda, tüketici mevzuatının sana tanıdığı haklar saklı kalmak kaydıyla, Türkiye'deki yetkili mahkeme ve icra daireleri yetkilidir. Yerleşik olduğun ülkenin emredici hukuk kuralları (tüketicinin korunması dahil) sana tanıdığı haklardan seni yoksun bırakmaz.

17. Genel hükümler

• Bölünebilirlik: Bu koşulların herhangi bir hükmü geçersiz veya uygulanamaz sayılırsa, kalan hükümler yürürlükte kalır; geçersiz hüküm, amacına en yakın geçerli hükümle değiştirilmiş sayılır.
• Feragat etmeme: Bir hakkımızı kullanmamamız veya geç kullanmamız, o haktan feragat ettiğimiz anlamına gelmez.
• Devir: Bu sözleşmeyi ve sözleşmeden doğan hak ve yükümlülüklerimizi; hizmetin devri, yeniden yapılanma veya birleşme hâlinde üçüncü bir kişiye devredebiliriz. Sen hesabını ve bu sözleşmeden doğan haklarını devredemezsin.
• Mücbir sebep: Makul kontrolümüz dışındaki olaylardan (doğal afet, şebeke/altyapı arızası, siber saldırı, savaş, mevzuat değişikliği vb.) kaynaklanan gecikme ve kesintilerden sorumlu değiliz.
• Bütün anlaşma: Bu koşullar; Gizlilik Politikası ve Topluluk Kuralları ile birlikte, hizmetin kullanımına ilişkin aramızdaki anlaşmanın tamamını oluşturur.
• Dil: Bu koşullar Türkçe ve İngilizce yayımlanır; iki metin arasında çelişki olursa, emredici mevzuat aksini gerektirmedikçe Türkçe metin esas alınır.
• Elektronik bildirim: Bildirimleri uygulama içinden veya hesabına kayıtlı e-posta adresine yapabiliriz; bu bildirimler yazılı bildirim hükmündedir.

18. App Store ve Google Play ek koşulları

Uygulamayı Apple App Store'dan edindiysen: bu sözleşme yalnızca seninle Voyarch arasındadır, Apple ile değildir; Apple uygulamadan sorumlu değildir ve uygulamaya ilişkin bakım/destek yükümlülüğü yoktur — bakım ve destekten biz sorumluyuz. Uygulama geçerli App Store kullanım kurallarına uymuyorsa Apple'a bildirebilir ve varsa satın alma bedelinin iadesini talep edebilirsin; yürürlükteki hukukun izin verdiği azami ölçüde Apple'ın uygulamaya ilişkin başka bir garanti yükümlülüğü yoktur. Ürün sorumluluğu, yasal veya düzenleyici gerekliliklere uygunluk ve tüketicinin korunması dahil uygulamaya ilişkin taleplerin ve uygulamanın üçüncü kişi fikri mülkiyet haklarını ihlal ettiği iddialarının ele alınmasından Apple değil biz sorumluyuz. ABD ambargosu uygulanan bir ülkede bulunmadığını ve ABD hükümetinin yasaklı veya kısıtlı taraf listelerinde yer almadığını beyan edersin. Apple ve Apple'ın bağlı şirketleri, bu koşulların üçüncü taraf lehdarıdır ve bunları sana karşı ileri sürme hakkına sahiptir. Google Play'den edindiysen Google Play'in geçerli koşulları da uygulanır.

Terms of Service

These terms are the agreement that governs your use of Voyarch. By using the app, you accept these terms. Please read them carefully.

1. Acceptance of terms

This agreement between Voyarch ("the app", "the service", "we") and you ("the user") takes effect when you create an account or use the app. If you do not accept these terms, you should not use the app. The service is currently directed primarily at users in Türkiye.

2. Eligibility & age

You must be at least 18 years old to use Voyarch. If you are under 18, you may not create an account or use the app or direct Messaging. You must provide an accurate date of birth and represent that you are an adult. False age information may result in restricted access or account termination.

3. Your account

• You must provide accurate and current information when registering.
• You are responsible for the security of your account and password, and may be held responsible for activity under your account.
• You may not transfer your account to others or create a fake account in someone else's name.
• You must notify us if you notice unauthorized use of your account.

4. Your content and the license you grant

You own the photos, videos, text, and other content you share ("user content"). You do not transfer ownership to us. However, so that we can provide the service — to display, store, reproduce, and deliver your content within the app to other users (subject to your visibility settings) — you grant us aworldwide, royalty-free, transferable, and sublicensable limited license. This license exists only to operate the service and ends when you delete your content (except for backups/technical necessities and the limited records we are legally required to retain, as described in Privacy Policy §6).

You represent that you hold all rights necessary for the content you share and that it does not infringe the rights of third parties (copyright, privacy, etc.).

A direct message you send to another user is also user content and is subject to the same service license so it can be delivered, stored securely, and reviewed in a limited way if it is reported.

5. Acceptable use

Voyarch is a community, and we have zero tolerance for objectionable content. You may not:

• share content that is illegal, threatening, harassing, hateful, discriminatory, obscene, or violent;
• harass, bully, threaten others, or expose their personal information without consent;
• spread spam, fraud, misleading, or unsolicited content;
• impersonate someone or create a fake account;
• infringe others' intellectual property rights;
• disrupt the app's operation, probe its security, or gain automated/bot access;
• post any content that exploits or endangers minors (strictly prohibited).

See the Community Guidelines for detailed conduct and content rules. They apply to posts, comments, and direct messages.

6. Location accuracy & honesty

Voyarch is built on you sharing the places you actually visit. Spoofing your location, using fake GPS, or attempting to post from a venue you are not at is prohibited. Where such cheating is detected, the related posts, points, or account may be suspended or removed.

7. Points, badges & gamification

The app includes gamification elements such as points, levels, season points, and badges. These have no real monetary value, cannot be redeemed for cash, and create no ownership or monetary rights. We may change scoring rules, seasons, and badges from time to time, and may correct or cancel points in cases of cheating or abuse.

8. Moderation, reporting & enforcement

You can report content or users and block accounts from within the app. We reserve the right to remove content that violates these terms, issue warnings, restrict features, and suspend or terminate accounts. For serious violations, we may act immediately without notice.

In a direct-message screen you can report a specific message and block the user as a separate action. Report review is limited to the selected message and up to five previous messages; moderators cannot freely browse user inboxes.

User content may be checked by automated text and image safety controls. Risky results may be reviewed by an authorized moderator with access limited to the content required for the task. Details appear in the Privacy Policy, Community Guidelines, and Child Safety Standards.

9. Intellectual property

The Voyarch name, logo, design, software, and all content other than user content belong to us and are protected by applicable law. You are granted only a limited, non-transferable license to use the app for personal, non-commercial purposes.

We may use suggestions and feedback you send us to improve the service, without any obligation or payment owed to you.

10. Third-party services

The app relies on third-party services such as maps, authentication, notifications, and storage. Those services may have their own terms. We are not responsible for external links or content you reach from the app.

11. Disclaimer of warranties

The service is provided "as is" and "as available." We do not warrant the accuracy, uninterrupted availability, or fitness for a particular purpose of place information, recommendations, or other content. It is your responsibility to stay aware of your surroundings and safety while using the app.

12. Limitation of liability

To the maximum extent permitted by applicable law, Voyarch is not liable for indirect, incidental, special, or consequential damages, loss of data, or damages arising from user content or the conduct of other users.

13. Indemnification

You agree to indemnify and hold Voyarch harmless against third-party claims arising from your use of the app, your content, or your breach of these terms.

14. Termination

You can freeze or delete your account at any time from within the app (see Privacy Policy§6). If you breach these terms, we may also terminate your access. Provisions that by their nature should survive termination (intellectual property, limitation of liability, indemnification, etc.) remain in effect.

15. Changes to the service and to these terms

We continuously improve the service and its features; we may change, suspend, or remove a feature. For changes that would significantly and adversely affect you, we aim to give reasonable notice.

We may also update these terms. For significant changes, we will notify you in the app or by email. Continuing to use the app after a change means you accept the updated terms.

16. Governing law & disputes

These terms are governed by the laws of the Republic of Türkiye. For disputes, and without prejudice to the rights granted to you by consumer legislation, the competent courts and enforcement offices in Türkiye have jurisdiction. This does not deprive you of the protection of mandatory rules of law (including consumer protection) of the country where you reside.

17. General provisions

• Severability: If any provision of these terms is held invalid or unenforceable, the remaining provisions stay in force; the invalid provision is deemed replaced by a valid one that comes closest to its purpose.
• No waiver: Our failure or delay in exercising a right does not mean we waive it.
• Assignment: We may assign this agreement and our rights and obligations under it to a third party in the event of a transfer of the service, restructuring, or merger. You may not transfer your account or your rights under this agreement.
• Force majeure: We are not liable for delays or interruptions caused by events beyond our reasonable control (natural disasters, network/infrastructure failures, cyberattacks, war, changes in law, etc.).
• Entire agreement: These terms, together with the Privacy Policy and the Community Guidelines, constitute the entire agreement between us regarding your use of the service.
• Language: These terms are published in Turkish and English; in case of conflict, the Turkish text prevails unless mandatory law requires otherwise.
• Electronic notices: We may give notices in-app or to the email address on your account; such notices count as written notice.

18. App Store & Google Play additional terms

If you obtained the app from the Apple App Store: this agreement is between you and Voyarch only, not Apple; Apple is not responsible for the app and has no maintenance/support obligation for it — we are responsible for maintenance and support. If the app fails to conform to any applicable App Store usage rules or warranty, you may notify Apple and, where applicable, request a refund of the purchase price; to the maximum extent permitted by applicable law, Apple has no other warranty obligation for the app. We — not Apple — are responsible for addressing claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection, and for handling claims that the app infringes third-party intellectual property rights. You represent that you are not located in a country subject to a US embargo and that you are not on any US government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you. If you obtained the app from Google Play, Google Play's applicable terms also apply.
